Smith, 812 A. 2d 683 (Pa. Super 2002). The Court in Gorski also cited Fiorentino v. Rapoport, 693 A.2d 208 (Pa. Super. 1997), app. den’d, 701 A.2d 577 (Pa. 1997), as supporting this interpretation of Bailey.
